Focus: Association / Civil Society

  • Legal framework: 

Constitution of 8 November 2006. 

Article 54.

Citizens shall have the right to assemble freely.

Indoor meetings are not subject to authorisation or registration.

Gatherings, demonstrations and other forms of open-air assembly must be declared in accordance with the law.

Freedom of assembly may be restricted by law only if necessary to protect public health, morals, the rights of others or the security of the Republic of Serbia.

Article 55.

Freedom of political or any other form of association is guaranteed, as well as the right to remain outside any association.

Associations shall be formed without prior authorisation and shall be registered by a state body in accordance with the law.

Secret and paramilitary associations are prohibited.

The Constitutional Court may only ban associations whose activities are aimed at the violent overthrow of the constitutional order, the violation of guaranteed human and minority rights, or incitement to racial, national or religious hatred.

Judges of the Constitutional Court, judges, public prosecutors, the public defender, members of the police force and the military may not be members of a political party.
