  • Legal framework: 

– Constitution of the Slovak Republic

Article 28.

  1. The right of peaceful assembly shall be guaranteed.
  2. In the case of assembly in public places, the law shall lay down the conditions for the exercise of this right which are necessary in a democratic society to protect the rights and freedoms of others, public order, public health and morals, property or national security. However, the holding of a public meeting must under no circumstances be subject to administrative authorisation.

 

Article 29.

  1. The right of association is guaranteed. Everyone has the right to associate freely with others to form associations, societies or other groupings.
  2. Citizens also have the right to form and join political parties and movements.
  3. The exercise of the rights referred to in paragraphs 1 and 2 may be subject only to such restrictions as are prescribed by law and are necessary in a democratic society in the interests of national security or public order, for the prevention of criminal offences or for the protection of the rights and freedoms of others.
  4. Political parties and movements as well as associations, societies and other groupings are separate from the State.

  • Legislative framework: 

Introductory provisions

 (1) Citizens have the right to associate freely.

(2) The exercise of this right does not require the authorisation of a State authority.

(3) This Act does not apply to the association of citizens

  1. a) in political parties and political movements,
  2. b) for the purpose of gainful activity or to ensure the proper practice of certain professions,
  3. c) in churches and religious societies.

 

Associations are not permitted

  1. a) whose purpose is to deny or limit the personal, political or other rights of citizens on the grounds of their nationality, sex, race, origin, political or other opinion, religious belief and social status. position, to incite hatred and intolerance on these grounds, to promote violence or otherwise violate the constitution and laws ;
  2. b) which pursue their objectives in a manner contrary to the constitution and laws 
  3. c) armed or with armed elements; associations whose members are not considered as possessing or using firearms for sporting purposes or for the exercise of the right to hunt.
